III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the operator <br />during the field inspection. The general area had recent snow and rain. However, there was no snow on site. <br />Roads <br />The main entrance road was in good condition. There was some sand on the loadout road for winter traction but <br />no sand had been tracked onto the main highway. No coal fines or coal dust were seen on the haul road or <br />highway either. The east side graveled road was in good condition. The gate was open. The light use road that <br />runs along the railroad tracks was passable. <br />Signs and Markers <br />Mine identification signs were up at the loadout's main entrance, the east side entrance and along the side road <br />near the railroad tracks. The required information was on each of the signs. Permit boundary markers were up. <br />Hydrology <br />There was a little standing water in the east pond. The gated primary was closed. The pond embankment was <br />well grassed and appeared to be stable. Pond inslopes were also stable. The emergency spillway of the pond was <br />well vegetated and had sufficient capacity. The dugout pond on the west side of the permit area was dry. The <br />single open channel spillway was functional. <br />Facilities <br />There were no problems at the loadout office, substation, material storage area and coal handling facilities. <br />There were no leaks at the fuel facility. <br />During the inspection, coal haul trucks were being unloaded and coal railcars were being loaded. There were no <br />fugitive dust problems while these activities took place. <br />Topsoil Stockpiles <br />The west side topsoil stockpile had a good vegetative cover, with no signs of erosional gullying. The topsoil <br />sign was on the pile. The east side topsoil stockpile had a moderate cover of vegetation. The topsoil sign was up <br />on this pile as well.
