III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. Bill Bear represented Bowie <br />Resources LLC. Longwall mining is almost finished in the B9 panel. Once finished, there will only be room and <br />pillar mining until Permit Revision No. 12 is approved. The general area had received snow and rain recently. <br />Main Mine Site <br />Mine id signs were up where the public roads enter the permit area. Two signs were along old highway 133, one <br />on the west end and one on the east end of the permit area. In addition, one sign was up along the Hubbard <br />Creek road where it enters the permit area. Also, mine id signs were up at the mine site entrance, at the entrance <br />to the material storage area across from the main entrance and at the entrance to the pump house facility. <br />There were no problems observed on the D-seam portal bench. No leaks were seen at the fuel facility. Ditches <br />and culverts were functional and clear of debris. There was a fairly large volume of stockpiled coal on the D- <br />seam portal bench and on the coal stockpile bench next to the highway. The outside berm on the coal stockpile <br />bench was in place. No coal fines were seen on the adjacent highway. Pond B was discharging and the discharge <br />was clear. The float was on the pond's primary discharge hose. The pond's embankment was stable. The pond's <br />two inlets, the riprapped ditch to the west and the ditch and culvert to the east, were functioning properly. <br />The road to the coal waste pile area was in good condition. The road berm and ditch were in place. Pond C had <br />water up to the discharge level but there was no discharge. The float was on the primary discharge hose. Pond D <br />only had a little water in it from snowmelt. <br />Unit Train Loadout <br />The mine id sign was up at the entrance off of Highway 133. There was no unit train at the loadout. Pond J was <br />dry while there was some snowmelt in pond K. The spur line bench outslope was well vegetated and appeared to <br />be stable. Half culvert downdrains were in place. Surface disturbance markers were up. <br />Hubbard Creek Fan Shaft Area <br />The road up Hubbard Creek canyon was in good condition. Along the way, three mine id signs were in place <br />where the public road enters the permit area. There also were two mine id signs at the Hubbard Creek fan site <br />area. Subsidence warning signs were up along the Hubbard Creek road at the lower end of the road and just <br />below the Hubbard Creek fan site area. <br />The fan site was covered in snow, except for the entrance which had been plowed. The fan was in operation. <br />Surface disturbance markers were in place. Between the road and Hubbard Creek, three stream buffer zone signs <br />were up and clearly marked. <br />c:/word2007/bowie2/inspO310
