III. COMMENTS- COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during the
inspection. Comments also describe any enforcement actions taken during the inspection and the facts or
evidence supporting the enforcement action.
This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator
during the field inspection. The flat facilities area was a little muddy while the hillside was partially snow
covered. There was no activity on site.
Sims and Markers
The mine identification sign and the"records location"' sign were on the same post at the top of the hill. The
required mine information was on the mine identification sign. Surface disturbance markers were up around the
disturbed area. The"no trespassing" sign was up on the front gate.
Roads
The paved haul road was clear of debris and was passable. The bridge over the North Fork of the Gunnison
River was passable as well.
Hydrology
The sedimentation pond had a little snowmelt in it. The gate on the pond's primary discharge pipe was closed.
The primary pipe outlet was clear of debris,as was the riprapped open channel emergency spillway. The
collection ditch leading into the sedimentation pond was well vegetated and had enough capacity. The road
culvert at the mine gate was clear of debris.
The hillside spring water treatment pond had water to within 8 inches of the horizontal pipe. The pond was
discharging at about 10 to 15 gpm. The discharge was the usual orange colored water, which has been found to
be in compliance with water quality standards. The hillside spring was flowing in its constructed channel and
culvert that lead to the treatment pond.
The riverside berm was in place and had sufficient height. The river was running low. Both well caps were on
alluvial wells AA-1 and AA-3.
Noxious Weeds
The tamarisk that had been growing along the water's edge at the hillside spring water treatment pond had been
recently cut down. Tamarisk was still growing at the hillside spring origin point on the hillside and near the
treatment pond's discharge point, however, and needs to be removed.
Reclamation
Scattered mine debris still needs to be removed. The reclaimed access road up to the reclaimed fan site was
partially snow covered but appeared to be stable. The reclaimed fan site also appeared to be stable.
c:/word2007/bear3/in sp0310
