111111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This partial inspection of the Carbon Junction Coal. Mine was conducted by DRMS staff from the <br />Durango Office at 691 County Road 233, Suite A-2, Durango, CO 81301, phone (970) 247-5469. No <br />individuals were contacted and no activities were observed during the inspection. One photo <br />accompanies this report. <br />Public access to the permit area is controlled by a locked gate at the mine entrance. <br />Vegetation continues to establish for all reclaimed areas. <br />The Carbon Junction Diversion appeared intact and capable of functioning as designed. Evidence of <br />recent and/or significant flows in the constructed channel was not observed. <br />,portions of the East Collection Channel remain intact and not reclaimed. <br />Previously, the East Collection Channel extended north to south through the permit area and routed <br />upland drainage and affected area drainage to the south sediment pond (Pond 1). The south <br />sediment pond has been backfilled. Likewise, approximately 1,300 feet of the lower reach of the East <br />Collection Channel has also been backfilled. However, there exist approximately 2,000 feet of East <br />Collection Channel still intact, but with no outlet. The intact portion of the East Collection Channel <br />terminates at the inlet to the triple culverts immediately south of Topsoil Stockpile 7 (photo). The outlet <br />of the triple culverts was not evident and appears to have been buried in reclamation backfill. The <br />remaining portion of the East Collection Channel has potential to deliver concentrated drainage to the <br />upland side of the mine entrance road at a section of the road which is not protected by a culvert. <br />Therefore, the installation of a new culvert, under the mine entrance road and at a location nearby <br />Topsoil Stockpile 7, appears prudent to ensure the long term stability of the mine entrance road.
