111. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This partial inspection of the King Coal 1 Mine was conducted by DRMS staff from the Durango Office, <br /> located at 691 County Road 233, Suite A-2, Durango, CO 81301, phone (970)247-5469. Operations <br /> appeared dormant at the King Coal 1 Mine. <br /> Both of the sediment ponds were holding water, water depth was visually estimated at three feet and <br /> well below discharge elevations. Inlets for primary spillways were clear. Outlets for primary spillways <br /> were still buried in snow and not inspected. Secondary spillways appeared well maintained and <br /> capable of functioning as designed. Pond embankments appeared stable with no evidence of <br /> slumping, settling or excessive erosion. The hydro-seed and mulch, applied to the pond <br /> embankments prior to snowfall, appeared intact. Evidence of emerging vegetative cover from the <br /> hydro-seed was not yet apparent. <br /> Hydro-seed and mulch had also been applied to the face of the refuse disposal pile prior to snowfall. <br /> However, these areas were still obscured by snow cover and were not inspected. <br />
