Send proof of publication to the above <br />letterhead Address. <br />PUBLIC NOTICE <br />New Elk Coal Company LLC, 122 West First St, Trinidad, CO 81082, the operator of the New <br />Elk Mine, Permit number C-81-012, is filing for a technical revision to the New Elk Permit with <br />the State of Colorado, Division of Reclamation, Mining and Safety. Permit C-81-012 renewal <br />was approved by the Division on April 13, 2009. For filing purposes, this technical revision <br />application was deemed complete by the Division on <br />The New Elk Mine is located approximately 7 miles west of Weston, Colorado on State Hwy. <br />12, within Sections 13, 14, 21, 22, 23, 24, 25, 26, 27 and 28, TS33S, R68W. These sections can <br />be located on the USGS 7.5 minute Vigil and Weston quadrangle maps. A total of 193.6 acres of <br />surface disturbance from mining related activity is covered by a Letter of Credit Bond in the <br />amount of $2,744,969. <br />The technical revision provides for the temporary storage of Development Waste Rock from the <br />New Elk Mine until a permanent disposal area can be accessed or permitted. Storage volume is <br />not to exceed 10,000 cubic yards. <br />The technical revision is on file for public inspection at the Las Animas County Courthouse, <br />Office of County Recorder and with the Division of Minerals and Geology. Any written <br />comments, objections or requests for a public hearing or informal conference regarding this bond <br />release application must be submitted to the Division of Minerals and Geology, 1313 Sherman <br />Street, Room 215, Denver, Colorado 80203 within 10 days of the date of the publication of this <br />notice. <br />Date of Publication:
