2009 ARRREVIEWDOIX 2 4/1/2010 <br />The long-term spoil remaining on site was reported in the 2008 ARR as 265,372.00 bcy. Approval of TR40 added <br />an additional 102,928 bcy to the long term spoil availability. CEC's 2009 ARR reported that 6,945 bcy of spoil was <br />utilized as ash cover in 2009. This should leave a balance of 360,455 bcy of soil in the long term spoil pile. <br />However, CEC reports that 354,018 bcy of spoil remain in the long term spoil pile. The <br />updated contours are in compliance with the approved post-mining topography map (Map Appendix Q-1, dated <br />4/29/2009). The contours shown on 2009 Annual Report Map Appendix Q-1 are consistent with that observed on <br />site. <br />Please provide responses to the Division's concerns regarding the variance in the seed mix composition and the <br />spoil mass balance to assure that the 2009 Annual Reclamation Report is in compliance with Rule 2.04.13.
