Specifically, you posed <br />two questions in your email that I received the morning of April 9, 2008. These questions were: <br />1) At what point, and by what evidence, will the Division release a portion, or all, lands from a <br />Division. Permit respective of an applicable PUD? <br />2) For greater clarity, must the PUD occupy all permitted lands or a portion, and should it cover <br />all permitted lands, can the release apply to just a portion of those permitted lands covered under <br />a PUD? <br />Generally, the Division of Reclamation, Mining and Safety (DBMS) will release a site from the <br />reclamation plan once a demonstration has been made by the operator through the city or county <br />that a PUD has been filed, reviewed and accepted and that adequate performance warranty has <br />been filed and accepted. This warranty must be sufficient to complete everything that would be <br />required to be reclaimed under the DRMS Reclamation Plan.
