Musch and Conner: <br />Following up on our recent telephone conversation, following is a summary of the compliance <br />issues and other outstanding items at the Lee No. 2 Placer. <br />1) You do not have to file a notice of Temporary Cessation if you will be active at the site this <br />year. Based on our conversations and the outstanding compliance issues, there likely will be <br />activity at the site this year. <br />2) Per rule, the sign must be replaced. However, due to the difficulty in maintaining a sign on <br />the site due to vandalism, the Division will not require you to continue to replace a sign that <br />disappears or is damaged by events beyond your control. Therefore, if you erect a sturdy sign <br />that would withstand ordinary wear and tear, and submit to the Division proof of its installation <br />in the form of a photograph, then we will have it on record that you attempted in good faith to <br />place the sign, and you will not be held accountable for future loss or damage of the sign. The <br />Division would like to see this activity completed by July 31, 2010. <br />3) Operators are not held financially responsible for historical equipment left on site by previous <br />operators. You are under no obligation to remove the equipment, nor will you receive any <br />credit in the calculation of the Financial Warranty for doing so. The purpose of the Financial <br />Warranty is to cover only the cost of reclaiming disturbances caused by the permitted operator. <br />Removing the equipment and cleaning up damage from a prior operator is commendable but <br />has no bearing on your bond with the Division. <br />4) Operators are not held liable for any disturbances outside the permit area that are caused by <br />the activities of others. If their activities or disturbances in any way encroach on your permitted <br />area, you would be advised to document it photographically to protect your interests. <br />5) Due to a mistake made by me in the original calculation, plus a reconsideration of equipment <br />costs, the required Financial Warranty remains unchanged at $1,200. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
