Page 11 <br />�• Section 1.04 <br />(12) "Application" means the documents and other related information filed <br />with the Board and the Division, in accordance with the Act and these <br />Rules, for the issuance of exploration approval or a permit. <br />103(3) (13) "Approximate original contour" means that surface configuration <br />achieved by baclriilling and grading of the mined areas so that the <br />reclaimed area, including any terracing or access roads, closely <br />resembles the general surface configuration of the land prior to mining <br />and blends into and complements the drainage pattern of the <br />surrounding terrain, with all the highwalls, refuse piles and spoil piles <br />eliminated. Water impoundments may be permitted where the Board <br />determines that they are in compliance with Section 34- 33- 120(2)(h) of <br />the Act and 4.05.9, 4.05.17 and 4.16. <br />(14) "Aquifer" means a zone, stratum or group of strata acting as a <br />hydraulic unit that can store and transmit water in sufficient quantities <br />for beneficial use. <br />(15) "Area" (with respect to designation of an area as unsuitable in Rule 7) <br />means an amount of surface land or water defined with sufficient <br />(• precision so as to enable the Board and other interested persons to <br />determine, with reasonable exactness, its location and size. An "area" <br />is generally larger than, and may encompass more acreage than, a <br />specific mine site. <br />(16) "Auger mining" means a method of mining coal at a cliff or highwall <br />by drilling holes into an exposed coal seam from the highwall and <br />transporting the coal along an auger bit to the surface. <br />(17) "Best technology currently available" means equipment, devices, <br />systems, methods, or techniques which will (a) prevent, to the extent <br />possible, additional contributions of suspended solids to stream flow or <br />runoff outside the permit area but in no event result in contributions of <br />suspended solids in excess of requirements set by applicable State or <br />Federal laws; and (b) minimize, to the extent possible, disturbances and <br />adverse impacts on fish, wildlife and related environmental values, and <br />achieve enhancement of those resources where practicable. The term <br />includes equipment, devices, systems, methods, or techniques which are <br />appropriate for intended use and are currently available, as determined <br />by the Division, even if they are not in routine use..
