Martin <br /> Executive Director <br />Paonia, Colorado 81428 <br />RE: Bowie No. 2 Mine, Permit No. C-96-083, Bowie Resources LLC <br />Permit Revision No. 12, West Mine Expansion, Agency Comment Letters <br />Dear Mr. Bear: <br />The Colorado Division of Reclamation, Mining and Safety has received three comment letters concerning <br />Permit Revision No. 12. Copies of the three letters are attached. The three letters are: <br />A comment letter from the Office of Surface Mining, dated March 15, 2010, in response to the <br />Division's request for a determination of whether PR-12 constitutes a mine plan modification. In their <br />letter, OSM stated that it had been determined that a mine plan modification requiring Secretarial <br />approval was not needed. Incidentally, the letter was mistakenly addressed to Dan Hernandez, rather <br />than to Sandy Brown. <br />2. A comment letter from the Bureau of Land Management, dated March 22, 2010, in which that agency <br />verified that the federal lease agreements and federal surface access agreements remain in place for <br />PR-12. <br />A comment letter from the Colorado Historical Society's (CHS) Office of Archaeology and Historic <br />Preservation, dated March 22, 2010. Because of the existence of three historic properties in the area, <br />the CHS requests further information on the effects from mine-induced subsidence and recommends <br />either avoidance or additional consultation.
