<br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 116,
<br />Paragraph 4, of the Colorado Revised Statutes, that on March 29, 2010, an application to revise coal mining operations at the
<br />North Thompson Creek Mine was considered complete for the purposes of filing. The revision was submitted by MINREC,
<br />Inc.. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing.
<br />The North Thompson Creek Mine has submitted a Technical Revision to their permit to add an NPDES Permit to their existing
<br />CDRMS Permit and to update their hydrologic monitoring plan. The NPDES Permit at the North Thompson Creek Mine was
<br />terminated by the Colorado Department of Public Health and Environment (CDPHE) on 14 March 2005. On or around 9 April
<br />2008 CDPHE notified the mine that they would need to apply for a new NPDES Permit. North Thompson Creek applied for a
<br />new NPDES Permit no 28 April 2008. On 22 December 2009 the CDPHE issued a new NPDES Permit for the North
<br />Thompson Creek Mine. This revision incorporates the new NPDES Permit into the North Thompson Creek Mine's CDRMS
<br />Permit.. It also updates the mine's hydrologic monitoring plan with the monitoring requirements of the new permit. This
<br />revision is administrative in nature. No new lands are proposed for incorporation into the permit and no new land are proposed
<br />for disturbance. There will be no increase in the mine's liability as a result of this revision.
<br />The underground coal mining operation is on land located approximately 10 miles southwest of Carbondale, Colorado. The
<br />permit area is further described as follows:
<br />T8S, R89W, Portions of Sections 21, 22, 27, 28, 33, 34 and 35; T9S, R89W, Portions of Sections 2, 3 and 4; T7S, R88W,
<br />Portions of Sections 20, 29, 30 and 32
<br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle maps of Stony Ridge, Carbondale and Cattle
<br />Creek.
<br />The applicant is required to publish notice in a local newspaper that this application has been deemed complete. At the time of
<br />publication of this notice, the applicant is additionally required to place a copy of this application at the Garfield County Clerk
<br />and Recorder, 109 8th Street, Suite 200, Glenwood Springs, CO 81601, and at the Division office. For additional information
<br />or to provide written comments, contact the Division of Reclamation, Mining and Safety, Room 215, 1313 Sherman Street,
<br />Denver, Colorado 80203, (303) 866-3567. In order for us to comply with regulatory time frames, we request that comments be
<br />submitted within fifteen (15) days of this letter. If no comments are received by then, we will proceed on the assumption that
<br />you have no concerns with, or objections to, the applicant's proposal.
