To support the <br />conclusions that the two areas are similar, site specific data from the Collom <br />expansion area must be analyzed, referenced and discussed.. <br />Colowyo Response: <br />Section 2.05.3(6) has been amended <br />Rule 2.05.5 - Post-Mining Land Use <br />16. This section of the PR-03 submittal is incomplete. Colowyo refers to Volume 1, <br />Section 2.05.5 for a description of the post mining land use. This section has not <br />been updated or revised to take into consideration the 16,833 acre Collom expansion <br />area. Rule 2.05.5(1) (a) requires a detailed narrative of the proposed use following <br />reclamation for the expansion area. Rule 2.05.5(1)(b) requires comments from the <br />landowners concerning the proposed post mining land use description. Rule <br />2.05.5(1)(c) requires that a map prepared to the standards of 2.10 shall accompany the <br />plan and must include the Collom expansion area. <br />Colowyo Response: <br />Section 2.05.5 has been amended. <br />Rule 2.05.6(2) - Mitigation of Impacts of Mining Operations, Fish and Wildlife Plan <br />17. This section of the PR-03 submittal is incomplete. Colowyo references Volume 1 <br />which does not include consideration of the Collom expansion area. Colowyo must <br />address Rule 2.05.6(2), Mitigation of the Impacts of Mining Operations, Fish and <br />Wildlife Plan, using the wildlife resources information provided for the Collom <br />expansion area in Section 2.04.11 and Exhibit 11 of the PR.-03 application. <br />Colowyo Response: <br />Section 2.05.6(2) has been amended. <br />Rule 2.06.8 - Operations on Alluvial Valley Floors <br />18. On page 100 Colowyo identifies the alluvial valley floor area that is along Wilson <br />Creek and adjacent to the Gossard Loadout. The page continues that this area is well <br />outside the drainage area of Collom Gulch and Jubb Creek. While this assertion is <br />correct for the mining in the Collom area it is not correct for the plant access and coal <br />haul road. The proposed road crossing location at Wilson Creek will potentially <br />impact this area. The AVF on lower Wilson Creek was discussed during the <br />permitting of South Taylor with Permit Revision 02 (please refer to the 9 September <br />2005 letter, comments 7 and 8). It was determined that the portion of the AVF where <br />the haul road crosses would need to be discussed and would need to specifically <br />address the requirements of Rules 2.06.8(4)(a)(i), (ii), (v) and (vi). Additionally, <br />Colowyo will need to demonstrate that the operation will. not result in any material <br />damage, pursuant to Rule 2.06.8(5)(a)(ii) and a monitoring program will need to be <br />Colowyo Mine C-1981-019 page 7 of 16 25 March 2010 <br />Permit Revision 03 - Collom Permit Expansion
