• Colowyo Response: <br />Updated information was approved through MR-98, and Section 2.03.4 has <br />been amended. <br />2. Rule 2.03.4(4) requires each application to identify the property ownership and right <br />of entry information. In the introduction to PR-03, Colowyo indicates that there is a <br />portion of unleased and unassigned Federal coal in the Collom area. While this lease <br />is not required for completeness, it will be required before a permit document can be <br />issued for PR-03. Please provide the status and timing of the lease application in this <br />section and be advised that a duly executed copy of the lease must be submitted to the <br />Division prior to permit issuance. <br />Colowyo Response: <br />Information will be updated during technical adequacy. At present, a bypass <br />lease application is being completed and will be submitted and secured prior to <br />Colowyo seeking final approval of PR-03. <br />Rule 2.03.5 - Compliance Information <br />3. The information in the permit application regarding the compliance information has <br />not been updated since early 2007 with the submittal of Permit Renewal 05. The proposed public notice for PR-03 is included at the end of Volume 15 as Figure <br />2.03.12-2. Please update the proposed public notice to include the revision number <br />(PR-03) and include a more detailed description of the anticipated operation. <br />Colowyo Response: <br />The public notice has been revised. <br />Rule 2.04.3 Site Description and Land Use Information <br />5. This section of the PR-03 submittal is incomplete. Colowyo has designated the pre- <br />mining land use as rangeland for the entire Collom expansion area. No site specific <br />land use details for the additional 16,833 acres have been provided as required by <br />Rules 2.04.3(l) and (2). <br />According to the Wildlife section, there is considerable wildlife use in the Collom <br />area including: Elk Resident Population area, Elk Winter Range, Elk Production <br />Areas, Mule Deer Critical Winter Range, Mule Deer concentration areas, Sage <br />.
