EXHIBIT G <br />Water Information <br />The Affected Area of the proposed Lyons Pit No. 2 - Permit No. M-80-248, Revision <br />No. AM-2 is 30.630 Acres. The topography and landform is similar to the existing gravel <br />operation and, based on our experience, Moffat County does not expect to intercept <br />ground water in the proposed affected area of this Amendment. <br />The landowners, Nicholas & Ann E. Charchalis, own the only water right that could be <br />affected by this operation. Notice in Exhibit C-3 (Topography Detail) that two small ditch <br />laterals terminate in the affected area near the south boundary of the Amendment. <br />Because the landowners leased the proposed affected area to Moffat County, it is <br />apparent that they do not intend to irrigate the land inside of the lease. <br />Moffat County will control stormwater by diverting it away from the natural channels in <br />the construction areas, and will develop berms, ditches, and settling; basins to manage the <br />sediment and to control erosion. This project will not intentionally divert stormwater for <br />beneficial use, or affect the "Waters of the State of Colorado and of the United States." <br />Local surface water may settle in the low areas of the excavations, and, if such water <br />collects in a substantial way, or if it becomes impounded for a substantial period of time, <br />the operator will notify the landowners (Charchalis) and will recommend that they apply <br />to the Colorado Water Court for a water storage right - then apply, the water to <br />beneficial use. <br />In the event groundwater is exposed, Moffat County will backfill the excavation so as not <br />to expose groundwater until a well permit has been obtained for the pit well pursuant to <br />CRS 37-90-13. <br />Moffat County will comply with all of the NPDES rules from the Water Quality Control <br />Division at the Colorado Department of Health, where necessary. <br />EXHIBIT G <br />Water Information
