Exhibit E <br />(Lyons Amendment 002 Reclamation Plan) <br />1. The "1997 Exhibit E Reclamation Plan; 1997 Exhibit D Mining Plan; and the <br />Conditional Revision Approval Letter, Moffat County, Lyons Pit No. 2, Permit No. M-80- <br />248, Revision No. CN-01 (March 28, 1991), for Amendment 001 (all of which are <br />attached to Exhibit D Amendment 002) are incorporated into this Exhibit E by reference. <br />The 1997 Reclamation Plan specifies in paragraph 2: <br />"For the existing and amended plans, which total 40.91 acres [39.58 acres <br />corrected] Moffat County will slope the sides of the excavation to a 4 to I <br />(horizontal to vertical) grade, or flatter. They will apply topsoil to the sloped <br />areas to a depth of 10" to 14 ". The topsoil will be seeded with alfalfa, and/or <br />with other dry crop seed of the landowner's choice. Moffat County will be eligible <br />for reclamation release after_ a successful crop harvest. " <br />2. The post-mining use of the land will be the same as the pre-mining use. That is <br />irrigated, and/or dry land crop use. And, Moffat County will leave a graded and drained <br />access road on the reclaimed property, and/or a small stock water impoundment in the <br />ephemeral drainage, if the landowner requests, otherwise, the total property will be <br />reclaimed according to this plan. <br />3. There will be no waste-rock dumps, tailing impoundments, underground mine <br />openings or buildings to address. <br />4. Exhibit F is a final topography plan of the excavation areas, assuming the pits <br />have been fully excavated; that they have been backfilled with excess overburden; and <br />that the land has been graded, sloped, and topsoiled at a ratio of 4:1 (horizontal to <br />vertical). <br />5. Moffat County will use berms, ditches, settling ponds and other techniques to <br />keep the stormwater drainage from flowing into (or out of) the mining areas. However, <br />the local precipitation, including the snow melt, cannot escape from the excavation pits. <br />If such local stormwater accumulates in the low areas of the pits in a substantial quantity <br />for an extended period of time, Moffat County will notify the landowners and <br />recommend that they file on the water right for beneficial use. <br />6. Moffat County will use the seed mix formula specified in Exhibit E-2. We will <br />limit our use of this formula to Overburden and Topsoil storage piles, and to stormwater <br />erosion prevention. The primary reclamation seed will be for irrigated and dry land crop <br />agriculture. The best time for seeding is in the spring and fall. <br />7. This timetable is listed in the Exhibit D Amendment No. 002 Mining Plan: <br />"Currently, there are 19.58 acres of the original Lyons Pit .No. 2 Conversion <br />Permit that are under reclamation now (just west of Amendment No. 001).
