Q P,
€cI OFFICE of ARCHAEOLOGY and HISTORIC PRESERVATION
March 18, 2010
Bob Oswald
Environmental Protection Specialist
Division of Reclamation, Mining and Safety
Department of Natural Resources
1313 Sherman Street, Rm. 215
Denver, CO 80203
iy\ - aaoq - da
Re: Asphalt Constructors, Inc., Alamosa Pit (File No. C-2009-094)
J
nC0 Dear Mr. Oswald:
777HILi
MAR 2 4 2010
Division of Ftaciarnwm,
Mining and SO* t-lv

As a follow up to a letter we wrote to you on February 2, 2010, we are responding to a recent inquiry
we received on the subject project. As stated in our February 2 letter, site 5AL139 was documented in
the project area. As this site was recorded over 30 years ago, its true extent and nature are not entirely
known, although we do know that there is a high potential for encountering archaeological deposits in
this dunal environment, including potentially, human remains.
Although a survey for cultural resources in the proposed project area is not required (per the State
Register Act CRS 24-80.1), we suggest that it may be helpful to ensure avoidance of cultural resources.
However, in the absence of an inventory, our office recommends that the proposed operations in this
area proceed cautiously and to be reminded that should human remains be discovered during mining
activities the requirements under State law CRS 24-80 part 13 apply and must be followed.
Thank you for the opportunity to comment. If we may be of further assistance, please contact Shina
duVall, Section 106 Compliance Manager, at (303) 866-4674 or shina.duvallQchs.state.co.us.
-Sincerely,
ward C.
