Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining, and Safety (DRMS) has received your response to the initial Preliminary <br />Adequacy Review. While the response clarified or corrected many issues, there are still several that need to be <br />addressed. Please find attached an Additional Adequacy Review sheet. Items that need additional clarification or <br />correction are in bold italics. Primary issues noted are: <br />Additional corrections on maps; <br />The issue of potential capture of the pit in a flood event by the Yampa. DRMS must have clear <br />documentation and information to ensure that either a) the pit does not have the potential to be <br />captured by the Yampa River or; b) structures will be engineered and constructed to prevent capture <br />should it be over taken by flood waters in a one hundred year event; <br />Documentation of proof of notice and identification of landowners within 200 feet of the proposed <br />project. <br />Per Rule 1.4.6(1) the decision date is March 26, 2010 provided all issues have been addressed. DRMS staff does <br />not have all information and corrections in order to do a reclamation liability estimate on or before the 26th to <br />finish up the decision process. The requested information regarding the flood plain and analysis will take time <br />beyond the March 26th decision date.
