Exhibit "D" <br />1) The statement of phase I, 30 acres should be removed. <br />C) (iv) Soil for reclamation will be disked and harrowed before being drilled with <br />seed mix. <br />(v) No mulching will be required. <br />(vi) Five Cottonwood trees and 5 willow trees per acre will be planted along <br />edges of pond during reclamation. <br />D) Ponds in the mining area will be left for waterfowl with the reclaimed slopes <br />being graded no steeper than 311: IV. <br />E) No waste rock or underground mine openings will be left after mine operations <br />cease. <br />Rule 3.1.7 <br />1) Ground water will be used for product washing on site, water will be <br />pumped from pit then returned for settling. De-watering will occur on site with a <br />sediment pond located on east side of pit (enclosed please find copies of well <br />permit application and discharge permit application). No chemicals will be used <br />on site for sediment control site will be graded so that storm water will drain into <br />pit. <br />2) Pit will have a well permit. Water from pit will be returned to river <br />causing no injury to existing water rights. <br />Rule 3.1.8 <br />1) The Division of Wildlife was contacted and agreed with a native grass for seed <br />mix and will send additional information. <br />Rule 3.1.9 <br />1) Topsoil stockpiled for more than 6 months will be disked and seeded to <br />prevent erosion. <br />2) Permit area is hay crop so there are no wooded areas in permit. <br />3) Topsoil will not be moved more than once. <br />Rule 3.1.10 <br />4) No livestock will be allowed in permit area until mining is completed. <br />6) Weeds will be sprayed twice a year until grass can be introduced. <br />Rule 3.1.12 <br />1) Proper signage and steel fence posts will be set for boundary markers. <br />Rule 3.1.13 <br />1) Northwest aggregates or operator of the pit will be responsible for complying <br />with requirements for spill reporting as outlined by the MLRB.
