Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Last Chance Mine, File No. M-2008-012, Amendment (AM-01) 112d-1, Decision Date Extension Denial. <br />Dear Mr. Cavanaugh and Carter: <br />The Division of Reclamation, Mining and Safety (DRMS) is reviewing Nuvemco's amendment which addresses changing <br />the above referenced 110(2) application to a 112d-1 permit application. DRMS review of the application has noted two <br />primary issues that require on site evaluations. One issue is a more defined radiometric survey of the portal area. The <br />second issue is a re-sampling of waste and ore rock for geo-chemical analysis. Unfortunately, conditions are not <br />favorable, due to snow cover, to access the mine and obtain the required data and samples. Nuvemco has requested a <br />60 day extension of the April 14, 2010 decision date to allow on site conditions to improve. <br />Per Rule 1.4.1(9) the application process must be completed within 365 days of being called complete or it may be <br />scheduled for a hearing before the Mined Land Reclamation Board (Board). The 365 day limit is April 14, 2010. <br />Therefore, DRMS cannot extend the decision date beyond April 14, 2010 and denies this request. Upon expiration of <br />the allowed 365 day review period, DRMS will schedule this matter for a Board hearing. At the hearing, the Board may <br />approve, approve with conditions, or deny the application. Due to 30 day notice requirements the hearing will be <br />scheduled for the June 9-10, 2010 Board meeting. At the hearing DRMS will submit an application decision <br />recommendation to the Board.
