7. Exhibit G indicates that Attachment G-2 contains a confidential mining lease. Information in the <br />lease agreement does not appear to satisfy the criteria for confidential information, as identified <br />under Rule 1.3(3). Please clarify whether the Applicant intended the Division to safeguard the <br />lease agreement as confidential, and if so, please demonstrate how the lease agreement satisfies <br />the requirements of Rule 1.3(3). <br />8. Attachment G-2 contains copy of a draft lease agreement between the Landowner (James M. <br />Clements) and the Applicant (Wildcat Mining Corporation), dated January 1, 2007. The draft lease <br />agreement is not signed by either party. Please provide copy of the signed agreement. <br />Exhibit J - Proof of Mailing of Notices to the Board of County Commissioners and Soil Conservation <br />District (Rule 6.3.10) <br />9. As indicated above, please provide proof of notice required by Rule 1.6.2(1)(a)(i) and (ii) for the <br />Board of Supervisors for the La Plata Conservation District. <br />The application for AM-01 at the May Day Mine will not be filed until the information listed above is . <br />received and found sufficient to begin the technical review. A decision date will be established 30 days from <br />the date of filing. If you have already published the public notice required under Rule 1.6.2(1)(d), you will <br />need to republish the notice after the Division determines that the application has been filed. The public <br />notice (Rule 1.6.2(1)(d)) must be published one time within ten days of the date of filing. The Division will <br />notify you when you should initiate publication of the public notice. The final date for receiving comments <br />is the 10th day after the newspaper publication, or the next regular business day. <br />Pursuant to Rule 1.4.1(8), you have 60 days from the date of this letter to submit all documents necessary <br />for the Division to determine the application complete for the purposes of filing.
