Cattany <br />Division Director <br />Natural Resource Trustee <br />On March 16, 2010, the Division received an application for Amendment No. 01 (AM-01) to the May Day <br />Mine. Pursuant to Hard Rock/Metal Mining Rule 1.4.1(8), the Division has conducted a preliminary review <br />of the application materials and has determined that the application is incomplete for the purposes of <br />filing. Pursuant to Rules 1.1(20.1) and 1.4.2(2), the following items must be received before the Division <br />can consider your application as being filed and commence the technical review. <br />Application Form <br />1. Please affix the corporate seal for the Applicant on page seven of the application form. <br />Public Notice (Rule 1.6.2) <br />2. Pursuant to Rule 1.6.2(1)(a), prior to submitting the application to the Office, the Applicant was to <br />send a notice, on a form approved by the Mined Land Reclamation Board, to the Board of County <br />Commissioners for La Plata County and to the Board of Supervisors of the soil conservation district. <br />Exhibit J of the application included proof of notice for the Board of County Commissioners for La <br />Plata County and proof of notice for the Alamosa office of the Natural Resources Conservation <br />Service (NRCS). Please note that the NRCS is a federal agency and the soil conservation districts <br />are state agencies. Please provide proof of notice for the Board of Supervisors of the La Plata <br />Conservation District, as required under Rules 1.6.2(1)(a) and 6.3.10. The La Plata Conservation <br />District is located at 31 Suttle Street, Durango, Colorado 81303. <br />3. The application includes copy of the notice (sign) required under Rule 1.6.2(1)(b). However, the <br />signed affidavit references the Idaho Mine. Therefore, the certification for the notice is confusing <br />and possibly in error. Pursuant to Rules 1.4.2(2)(b)(iii) and 1.6.2(1)(b) and (g), please provide a <br />signed affidavit that the appropriate notice has been posted for the May Day Mine.
