The maximum slope gradient created during all mining phases and the final reclamation slopes will be 3H:1 V. This
slope appears adequate for stability during mining and for long-term reclamation. This slope must not be exceeded
unless the plan is formally revised. One important reason to maintain this slope is because it affects the bond amount.
As such, this will be an item we inspect for in the future.
Exhibit R - Proof of Filing Materials at the County Clerk and Recorder (Rule 6.4.18)
This exhibit is adequate, in that you have now provided proofs of all filings to-date. Please ensure that you continue to
file future application materials and submit to this office the receipts you obtain therefor. This must be received by
this office before the decision date.
Decision Date
The Division's decision date is currently set for April 20, 2010. Please try to respond to all adequacy items included in
this letter. All adequacy response materials should be submitted in duplicate and at least several days before the
decision date to allow sufficient time to review the materials.
I must state that if the application is not adequate for approval by the close of business on the decision date, the
application may be denied. If additional time is needed for preparing and submitting your responses, please send me a
written request for an extension, specifying the length of additional time needed.
Thank you for the quality and timeliness of the adequacy responses you provided. You may send all written materials
directly to me, or contact me if there are questions, at the Division's Durango field office: 691 CR 233, Room A-2,
Durango, CO 81301; telephone 970-247-5193.
Sincerely,
Bob Oswald
Environmental Protection Specialist
Ec: Steve Shuey, DRMS
(cA10-03\aci alamosa 112 adg2/rco)
