Box 535 Somerset, Colorado 81434 USA Tel (970)929-5122 Fax <br />(970)929-5177 <br />PRECEIVE® <br />March 19, 2010 MAR 2 5 2010 <br />Mr. Mike Boulay Minino ?-Ild SatetY <br />Environmental Protection Specialist <br />Colorado Division of Reclamation, Mining and Safety <br />101 South 3`d, Suite 301 <br />Grand Junction, CO. 81501 <br />Re: Oxbow Mining LLC, Permit No. C-1981-022 <br />TR-68 - Application for Methane Drainage Facility at Elk Creek Fan Bench. <br />Dear Mr. Boulay, <br />This letter is to request Technical Revision No. 68 to the Oxbow Mining LLC (OMLLC) Permit <br />No. C-1981-022. <br />The purpose of the TR is to expand the upper Elk Creek Mine Fan bench by approximately 0.1 <br />acres to facilitate completion of a 210' deep, 18" steel cased methane drainage borehole and <br />construction of a twin electric driven methane exhauster system. The methane exhauster system <br />is similar to the facility located at the Bear Creek Fansite Facility. Approximately 1,500 cubic <br />yards of material will be hauled from the present borrow area located west of the mine portal <br />area to build out the pad. The area is presently disturbed and covered by rocks and boulders <br />salvaged from initial Elk Creek Mine construction and presently utilized as erosion protection for <br />the Small Area Exemption. The rocks and boulders will continue to be used on the new outslope <br />of the pad area for erosion and sediment control. The final elevation of the expanded pad area <br />will match the present fan pad bench elevation and the minimal surface drainage will be routed <br />south and comingle with current fan pad bench area. <br />The methane drainage borehole will be completed to intercept the underlying mine workings. <br />The borehole casing will be cemented in place and used to connect the methane exhausters to the <br />underground mine pipe which will be used to drain methane from the east end of the north <br />mining district. Presently to meet MSHA requirements, methane from the east end of the north <br />panels is drained through over 3 miles of 12" underground mine pipe and routed to the Bear <br />Creek Fansite. <br />The building covering the exhauster apparatus will consist of a foundation of footings, piers and <br />concrete slab using approximately 28 cubic yards of reinforced concrete.
