W AATMW OF of o <br />NIRWI 0 u LuN-. <br /> <br />MAR 2 4 2010 <br />Division of Rwimagwj, <br />AMn#nq and Safety <br />In your letter dated March 4, 2010 you requested that BLM verify that Bowie Resources LLC (BRL) has Federal <br />Lease agreements and Federal Surface access agreements upon which BRL base their legal right to enter. <br />This letter serves as verification that those agreements do exist, and are in place. The leases are part of a Logical <br />Mining Unit (LMU) which is currently in suspension; however, once re-entry is made for the purpose of mining the <br />coal, that suspension will be terminated. Meanwhile the agreements stand for the leases individually and for the <br />LMU. <br />Under the lease agreements BRL has a right to access and construct suface facilities that serve the underground <br />mining operation as long as they abide by all the terms and conditions of the lease; especially those sections <br />intended to protect other resources during surface disturbing activities. <br />If you have any questions please call me at 970-240-5302. <br />Sincerely, <br />r <br />Desty Dyer, Mining Engineer
