Berry, P.E. prepared: Geotechnica/ and
Hazards Investigation Moores Pit, dated: March 3, 2010. The report concluded, "as long as the mining
operations provide some protection against raveling of material during the early stages of mining and
provided the mining is conducted in accordance with the mining plan, HBET does not believe that the
mining of materials in the western portion of the site will adversely impact the stability of the existing slops
along Highway 141 ". Because of the results of the slope stability study the mining operations should not
affect any of the above listed structures. In the unlikely event that any of the structures are damage due
to the mining activities, the operator will replace and or repair the damage at no cost to the owner.
