March 16, 2010
Mr. Charles R. Ponchak
Consulting Geologist
15292 6050 Road
Montrose, CO 81403
Re: Mt. Sneffels Mining Co., Mineral Exploration
Dear Mr. Ponchak:
wey"
(BAR e4 2 2010
Div4jon vt eociams im,
Mining and Safety
RECEIVED
MAR 17 2010 t/
BRAND JUNCTION FIELD OFFICE
DIVISION OF
RECLAMATION MINING & SAFETY

We appreciated the opportunity to meet with you as well as Keith and Sarah Emmett last week
(March 8`h) to discuss the Mount Sneffels Mining Co., project pending in Ouray County. As we
discussed in our meeting, it is the County's current position that an approved Special Use Permit
will be needed in order to proceed with your proposed exploration program.
Ouray County is taking a similar position as the State and the Forest Service and evaluating the 27
proposed sites as 1 project. The cumulative impacts for all sites, including pads and access roads
appears to be well over 1-acre, and as such falls under the County's definition of a Mineral
Operation. Mineral Operations is a use allowed by Special Use Permit in the Alpine Zone.
It is my suggestion that we schedule a follow-up meeting to discuss submittal requirements for
your Special Use Permit. If you have any questions or would like to set up a meeting, please feel
free to contact me directly. Please note that should Mt. Sneffels Mining Co. disagree with the
position of the Land Use Department, they have 30 days from the date of this letter to appeal the
matter to the Board of Zoning Adjustment.
Thank you.
-?Z,
1&?-
Mark S.
