We have received your minor revision application to revise your permit to conduct coal mining in Colorado. Our
initial review indicates that all preliminary items required by the Colorado Surface Coal Mining Reclamation Act,
Section 34-33-101 et seq., C.R.S., have been submitted. Thus, your application has been considered complete for
the purposes of filing as of March 17, 2010. All review and comment periods as provided in the Act and the
Regulations initiate from this date of filing.
The Division has conducted a preliminary adequacy review of the referenced application, and we have identified
the following concerns:
Based on the Exhibit "A" exploration map submitted for inclusion in proposed Attachment 12-4
"Permission to Conduct Exploration Drilling", it appears one exploration hole was previously drilled in
the permit area in 2008 (ccu028), and a second hole would be drilled in 2010 (ccu049-2010), both by
Peabody Sage Creek Coal Company. The dates of drilling and specific Notice(s) of Intent under which the
original hole was drilled and the proposed second hole would be drilled are not specifically addressed in
the Attachment 12-4 narrative. Please amend the narrative to specify the Notice(s) of Intent to which
Attachment 12-4 applies, along with dates of previous and planned drilling for designated drill
holes.
2. In the last sentence of the Attachment 12-4 narrative, there is reference to "attached Exhibit I". The map
provided is actually labeled "Exhibit A". Please revise the narrative reference as appropriate.
