Discussions with the BLM have resulted in agreement <br />to modify the original and amended mining plans. The. modification entails extension of <br />mine phases to the east of the current phases within the 40.51 permitted acreage. BLM <br />has recommended that the total area of disturbance not exceed 10.99 acres as described <br />more fully in the attached BLM permit documents. This implies that reclamation must be <br />completed in proportion and "prior to disturbance in the extension areas (phases. 8 and 9). <br />To-date, approximately, 7.7 of the 10.99 acres have been, disturbed leaving 3.3 acres <br />available for future mining. Reclamation work was begun'1in the, northwest section of <br />Phase 5 a few years back. It is the intent of the operator to complete the required seeding <br />o€this section in the spring or fall of 2010. <br />Mining Plan Revision The- overall plan submitted in the 1998 Amendment will ,apply to <br />the extension area. The attached Exhibit C (R) shows the mine extension area as Phases. 8 <br />and 9. Preservation of 'available vegetation, topsoil and overburden removed in the <br />extension area will be done in accordance with the current plan. Stormwater drainage <br />from the extension area will be controlled with the existing detention pond in Phase 3 in <br />the lower pit and with additional straw bale or excelsior wattles,placement within the <br />center drainage feature as necessary. No offsite discharge of stormwater will result from <br />'activities within the mine extension area. <br />Reclamation Plan Revision As with the mining plan, no alterations to the scope of <br />reclamation are anticipated. The same standards, in terms of 3:1 (H: V) reclaimed slopes, <br />grading and seeding.: criteria are applicable to the extended mining`area. Exhibit E (R) <br />(attached) illustrates the general final topography of the extended mining area. <br />Ute Mountain Ute Tribe The applicant/ operator does not intend to close the existing <br />access trail through Phases 5 and 7. Where necessary, the route has been redirected to <br />allow for mining and processing, but access to the reservation boundary will remain <br />throughout the life of the mine. The Ute -Mountain Ute Tribe was notified of this issue <br />and the pending renewal, of the BLM permit and the proposed`DRMS technical revision <br />request.
