Instead they
will allow excavation of the wetland areas under the Tulloch Rule....Accordingly, we have withdrawn
from the ACOE our 404 permit application."
Mr. Green confirmed Precision will not be required by the Army Corp. to obtain a 404 permit, due to a
revision to the mining plan which, will not backfill the former wetland areas with any fill material
(including overburden and topsoil). The wetland areas must be mined by bucket to the final grade.
The approved post mining land use is developed water resource, which should not require backfill of
the pit after mining.
Type of Interaction: Meeting (Ph;) Other
Person(s) contacted and affiliation: Nathan Green; U.S. Army Corps of Engineers
Summary and Resolution of Interaction: The Division of Reclamation, Mining and Safety accepts
Precision's statement that a 404 permit is not required by the Army Corps. for the Camilletti-Milner Pit
#2.
c:\acs files\My Documents 4-19-06 tlnu\ mt£doc
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
