Martin <br />Executive Director <br />Called Nathan Green with Army Corps. of Engineers at 970.243.1199 x12 to discuss Precision's <br />statement in the letter dated February 19, 2010 that, "The ACOE has decided that they will not issue a <br />404 permit to provide off-site mitigation of the affected wetlands within the pit boundary. Instead they <br />will allow excavation of the wetland areas under the Tulloch Rule....Accordingly, we have withdrawn <br />from the ACOE our 404 permit application." <br />Mr. Green confirmed Precision will not be required by the Army Corp. to obtain a 404 permit, due to a <br />revision to the mining plan which, will not backfill the former wetland areas with any fill material <br />(including overburden and topsoil).
