CONDITIONS FOR APPROVAL
® The purpose of the amendment is to increase the permitted area of the S&H Mine from 1239.40 acres to a
total of 1508.63 acres. This amendment increases the reserves of gravel in the mine and the life of the
mine.
® The proposed operation will consume ground water by: ® evaporation, ® dust control, ®reclamation,
water removed in the mined product, ® processing, ® other: dewatering.
Prior to initiation of these uses of ground water, the applicant will need to obtain either a gravel pit or other
type of well permit, as applicable. However, prior to obtaining a permit, an approved substitute water
supply plan ("SWSP") or decreed plan for augmentation is required. According to the State Engineer's
Office records an SWSP was approved on February 22, 2010 and that plan will expire on December 31,
2010.
® In accordance with Section 37-90-137(2) and (11), C.R.S., the applicant obtained well permit no. 65464-F.
However with the proposed expansion the Applicant will be required to obtain a new well permit if
additional acreage will be exposed beyond what is allowed by well permit no. 65464-F.
? The proposed operation may have potential impact on existing water rights near the project location.
Applicant needs to demonstrate that the proposed project will not alter or impact the historic operation of
existing water rights.
? The applicant has indicated plans to use other water for purposes at the permit site. The source of
water for this use is to be obtained from . Applicant needs to document that this water was diverted
in priority under a water right decreed for such industrial use. Applicant should contact the water
commissioner for further information.
COMMENTS: If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it must
be released to the stream system within 72 hours. This may require a discharge permit from CDPHE-WQCD.
Otherwise, the operator will need to make replacements for evaporation.
