III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a Complete Inspection of the Hamilton Mine conducted by Marcia Talvitie of the <br />Colorado DRMS beginning at 10:45 a.m. on Thursday, 29-Jan-2010. No representative of the <br />operator was present during the inspection. The skies were clear, and temperatures were cool <br />to mild. <br />Availability of Records <br />Records were available for review at the Broad Canyon Landfill office. A completed DRMS <br />Availability of Records form is attached. <br />Roads <br />Roads within the permit area were covered with approximately 2" of snow, but conditions were <br />quickly becoming muddy as the day warmed. Access by vehicle was possible as far as the top <br />of the hill between Ponds A and B. Access to Mining Area No. 3 was not attempted. <br />Hydrologic Balance <br />Snow had melted from south-facing slopes. Ground conditions were muddy, and it appeared <br />that the frost was coming out of the ground due to the warmer temperatures. North-facing <br />slopes were still snow-covered. <br />Ponds A and B (Photo 1) were both dry. <br />Topsoil <br />The topsoil stockpile at Pond B was stable, with snow covering the north-facing slope (Photo 2). <br />General Mine Plan Compliance <br />The fence along the east side of Mining Area No. 1 was inspected on foot and appears to be <br />intact (Photos 3 and 4). <br />Fish & Wildlife <br />Elk tracks were plentiful throughout the permit area. In previous winters, mule deer have been <br />more numerous. Heavy snows in the higher elevations have apparently pushed the elk into this <br />area. <br />Due to slippery conditions, the field inspection concluded at 11:30. <br />Hamilton Mine C-1991-078 29-Jan-2010
