Permit No. M-2000-158 <br />Dear Mr. Ebert, <br />111EC" <br />MAR 12 2010 <br />Division of meclamation, <br />Mining and Safety <br />Weld County Public Works is familiar with this permit as it is currently being reviewed by FEMA under a <br />Letter of Map Revision (LOMR). The LOMR was submitted to FEMA to gain their acceptance of the <br />existing floodplain and floodway conditions. Weld County has had discussions with the applicant's <br />engineer regarding the water storage component of the reclamation plan. Weld County understands that <br />fill will be placed in the floodplain to provide embankments around the reclaimed gravel pits to maximize <br />the amount of water storage available. <br />DRMS should be aware that FEMA, the State of Colorado Water Conservation Board, Weld County, and <br />the Town of Milliken have floodplain regulations that potentially impact how the site can be used after <br />reclamation. The agencies have regulations regarding the erosional stability of the fill to be placed in the <br />South Platte River Floodplain. FEMA also has regulations that require a conditional letter of map revision <br />(CLOMR) be approved prior to the placement of any fill in the floodplain. The CLOMR has to show what <br />kind of impacts the proposed project will have on the 100-year flood water surface elevations on <br />properties upstream, downstream, and adjacent to the pit. The CLOMR must be submitted per FEMA <br />requirements and must show that the 100-year flood water surface elevations are not increased on <br />adjacent properties without the property owner's written consent. Once the CLOMR is accepted by <br />FEMA, the applicant can begin placing fill in the floodplain and create the embankments for the water <br />storage reservoirs. Once the project is completed, FEMA requires that another LOMR be completed <br />showing the as-built condition and the affects of the embankments on the water surface elevations on <br />adjacent properties. <br />In order to ensure that Weld County citizens are not adversely impacted by the change in the reclamation <br />plan, Weld County respectfully requests that a condition requiring the applicant to obtain a CLOMR for <br />water storage from FEMA be added to DRMS conditions of approval.
