This project is located adjacent to the Yampa River east <br />of the City of Craig within Section 3, Township 6 North, Range 90 West, 40.5090448° North <br />Latitude, -107.4696078° West Longitude, Moffat County, Colorado. <br />In your letter, you asked for us to provide you with information as to the specific location of <br />the fill within previously delineated wetlands. I have included photographs marked with red <br />circles showing the locations of the fill piles in question. <br />We estimate the unauthorized filling of 0.78 acre of jurisdictional waters of the United <br />States has occurred at this site. While you have identified that the fill within these wetlands has <br />been removed, it constitutes a violation of the Clean Water Act and requires remedy. As our <br />previous letter of November 12, 2009 states, we are coordinating this action with other Federal <br />and state agencies to determine a lead enforcement agency and the next appropriate step. <br />Enforcement resolutions range from fines and site restoration to issuance of an after-the=fact <br />permit. In the meantime, we have directed that all activities within jurisdictional waters of the <br />United States cease until this violation is resolved. If you have any additional information to <br />provide on this issue, please do so no later than March 19, 2010.
