On behalf of <br />Longacre Ranch, RLLP, I am denying your request to enter onto our land and to <br />remove the silt and sand within the draw on the south side. <br />I have a real problem here Greg, and it's not just a matter of cleaning up the silt <br />and sand. I had the soil and shallow groundwater tested and there are traces of <br />hazardous compounds in the draw to the south. Based upon the samples <br />collected by Harper Environmental Management, we believe this may have been <br />carried by the sediment washed from the permitted area. We have been advised <br />that disturbing the soil above the stock pond may cause more problems than it <br />would solve if it is not handled correctly. <br />Controlling the sediment wash onto our property, all sides of our property, is <br />critical here, not just in a "flood" year. We understand that you are attempting to <br />comply with the Division of Reclamation and Mining's order, however, based <br />upon what was discovered by our test results, I believe a second opinion is <br />needed. <br />I have contacted Ron Greene of Western Clean Up to review the paperwork <br />prepared by Harper Environmental Management. As soon as Ron completes his <br />work, I will advise you of our preferred course of action. In the meantime, do <br />whatever it takes to prevent additional sediment wash onto our property. <br />Sincerely, <br />John E.
