Ebert <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Rm. 215 <br />Denver, CO 80203 <br /> <br /> <br />MAR 10 NM <br />Division of Reclamation, <br />Minim & Safogy <br />Re: Platte Sand & Gravel, LLC, S & H Mine (Permit No. M-2000-158) (CHS #35211) <br />Dear Mr. Ebert: <br />Thank you for your correspondence dated March 2, 2010 (received by our office on March 3, 2010) <br />regarding the subject project. <br />A search of the Colorado Cultural Resource Inventory database indicates that several cultural resource <br />inventories have been conducted near the proposed project area and at least two historic properties are <br />located therein. Site 5WL814, the Fort St. Vrain Monument, is Listed on the National Register of <br />Historic Places (NRHP). Site 5WL870, Fort St. Vrain Railroad Siding site has been determined to need <br />additional data to assess its eligibility for the NRHP. According to CRS 24-80-409, no person may <br />"knowingly appropriate, excavate, injure, or destroy and historical, prehistorical, or archaeological <br />resource on land owned by the state or any county, city and county, city, town, district, or other <br />political subdivision of the state." It appears from our records that the operator agreed to avoid these <br />sites in 2001 when the initial permit application was received. We recommend that the operator <br />continue to avoid these sites or that additional inventory be conducted to determine the effect of the <br />proposed project on this resource. If site avoidance is not possible, we recommend further <br />consultation with our office in order to identify options to avoid, minimize, or mitigate the adverse <br />effect to the sites. <br />Should human remains be discovered during mining activities the requirements under State law CRS <br />24-80 part 13 apply and must be followed. <br />Thank you for the opportunity to comment.
