Hays MAR 0 6 2010 <br />Environmental Protection Specialist Division of Reclamation, <br />Division of Reclamation, Mining and Safety Mining & Safety <br />Department of Natural Resources <br />1313 Sherman Street, Rm. 215 <br />Denver, CO 80203 <br />Re: Leone Sand & Gravel LLC, Leone Huerfano- Gravel- Pit (File No. M-2010-004) (CHS #56642) <br />Dear Mr. Hays: <br />Thank you for your correspondence dated February 25, 2010 (received by our office on February 26, <br />2010) regarding the subject project. <br />A search of the Colorado Cultural Resource Inventory database indicates that no cultural resource <br />inventories have been conducted near the proposed project area but at least one historic property is <br />located therein. Site 5HF398 was last recorded in 1981. It was determined to be eligible for the <br />National Register of Historic Places (NRHP) based on a field assessment. We recommend that the <br />operator avoid this site or that additional inventory be conducted to determine the effect of the <br />proposed project on this resource. If site avoidance is not possible, we recommend further <br />consultation with our office in order to identify options to avoid, minimize, or mitigate the adverse <br />effect to the sites. <br />Should human remains be discovered during mining activities the requirements under State law CRS <br />24-80 part 13 apply and must be followed. <br />Thank you for the opportunity to comment.
