III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division). This former contour strip operation is bond <br /> revoked. All remaining funds from the bond revocation at this site were spent in 2004 for ditch <br /> repairs. The Division is in the final stages of the process to terminate jurisdiction at this <br /> revoked site. As per Division policy and in accordance with Rule 3.03.3, the Division may <br /> terminate jurisdiction upon a written determination that all requirements of the Rules and the <br /> Act have been successfully completed and a final decision has been made in accordance <br /> with the bond release procedures of Rule 3.03. Ground conditions on this day were snow- <br /> covered from a significant winter storm that occurred in the last 48 hours. The weather was <br /> sunny and cold. <br /> Revegetation <br /> Snow cover limited any ground observations. No evidence of any significant change to the <br /> reclaimed areas was evident. Land stability has been demonstrated over the reclamation <br /> liability period.
