RAiNDANCE ACQUATIC INVESTMENTS, LLC <br />1625 Pelican Lakes Point, Suite 201 <br />Windsor, Colorado 80550 <br />970-686-5828 <br />March 4, 2010 <br />State of Colorado <br />Division of Reclamation, Mining 'and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Via Certified Mail Return Receipt Requested <br />Re: Annual Report for Raindance Acquatic Investments, LLC, Permit No. M- <br />2004-022, known as the Raindance Sand and Gravel Mine <br />Gentlemen: <br />Pursuant to C.R.S. 34-32.5.5-116 and C.R.S. 34-32-116, please accept this as our <br />Annual Report for the calendar year 2009. Hilltop Acquatic Investments, LLC was <br />formed on November 28, 2001 and subsequently changed it's name to Raindance <br />Acquatic Investments, LLC on April 15, 2004 (hereinafter referred to as "Raindance <br />Acquatic"). Our check for the annual fee of $791.00 is also enclosed herewith. <br />The mining operation on this property ceased in September, 2008. Colson <br />Excavation was the mining operator for this site under a Royalty/Lease process with <br />Raindance Acquatic. <br />In 2009, Colson worked to remove piled inventory from this site. Colson will <br />finish with that removal in 2010. In addition, an inspection was performed in May, 2009, <br />and, since the reclamation was not complete, the reclamation release was not granted. <br />Additionally in 2009, Harvey "Bud" Branson was no longer responsible for oversight <br />duties of the site. His replacement, Richard von Bernuth, P.E., is now responsible for <br />oversight of the site. As there has been no new disturbances nor has any reclamation <br />occurred during 2009, we have not included a new map of the site. <br />Our plans for 2010 include finishing the reclamation by seeding the areas as <br />described in the plans. In addition, we plan to remove the fuel tanks and temporary office <br />structures. <br />Membership and ownership percentages of Raindance Acquatic Invesments, LLC <br />are: <br />Martin Lind, Manager 37.5% <br />Viki Lind 27.5% <br />Seth Ward, Co-Manager 17.5% <br />Kaye Ward 17.5% <br />3/4/10AMning Annual Report 2009.wpd
