MINE ID # OR PROSPECTING ID #: M-1991-096 <br />INSPECTION DATE: 2-1R-7n1n INSPECTORS INITIALS: 11F <br />OBSERVATIONS <br />This was a normal monitoring inspection of the Earl-Hoffman-Reyher Pit #3, DRMS File No. M-1991-086. This <br />site is located approximately 2.5 miles south and 1 mile east of McClave, Colorado in Bent County. I, Jared <br />Ebert of the Colorado Division of Reclamation, Mining and Safety conducted the inspection. Mr. Curtis Sniff of <br />Bent County accompanied me on the inspection. <br />This is a 112c operation with a permit area of 23.796 acres. The Operator has excavated an area on a rise just <br />above the Arkansas River. A haul road loops in and out of the site on the western side of the site. The topsoil <br />is stockpiled adjacent to the western marked permit boundary. This pile is stabilized with native vegetative <br />cover. One large stockpile of mined material is located on the southeast end of the permit boundary. The <br />Operator extracts material as it is needed from this stockpile. A 5-10 foot highwall excavation appears to be <br />advancing north on the northern portion of the mine site. It appears a small area was excavated on the <br />eastern end of the site in the "Phase 3" area. A small berm of material encompasses this excavation and <br />vegetation has begun to establish in the area. <br />The permit boundary was marked with metal posts and was measured using a Trimble GPS unit. A map of the <br />Division's finding is included with this report. The marked boundary delineates an area of 19.4 acres which is <br />about 4.396 acres less than what is approved. Also, the boundary is not the same configuration as it is <br />currently approved. The small excavation on the eastern side of the site is slightly outside of the marked <br />boundary. Since the boundary is marked incorrectly, it is unclear if this excavation is outside of the permit <br />area. The current approved permit boundary is very confusing and unclear. This problem was discussed with <br />Mr. Sniff, and it was agreed the County could clarify the permit boundary through a Technical Revision and re- <br />mark the permit boundary to encompass 23.796 acres. This issue is cited as a problem at the end of the <br />report and will require corrective action to be taken by the Operator. <br />In order to correct this issue, the County will need to submit a Technical Revision to the current approved <br />mining plan with the following information: <br />1.) Updated Mining Plan Map with: <br />a. Appropriate map title with the name of the operation and the DRMS file number. <br />b. Display the Name of the Operator <br />c. Map must be signed by the registered land surveyor, professional engineer, or other qualified <br />person who prepared the map. <br />d. Display the date the map was prepared. <br />e. Updated permit boundary. <br />i. The permit boundary must encompass 23.796 acres. <br />f. Include a proper scale and ensure the map is drawn to a scale no large than 1 inch =50 feet or <br />smaller than 1 inch = 660 feet. <br />g. Include an appropriate legend and north arrow. <br />h. Please display the haul roads, and the Arkansas River. <br />i. Please show the location of the topsoil stockpile. <br />2.) Fee for a Technical Revision is $216.00
