(Page 2) <br />MINE ID # OR PROSPECTING ID #: AIL-19R5-M9 <br />INSPECTION DATE: 2/jA/in INSPECTOR=S INITIALS: _MAC <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). David Seymour of Lincoln County was also present for the inspection. The Arthur L Schmeiser pit is <br />located approximately 13 miles west of Punkin Center, Colorado. The site is permitted for 3.2 acres and the post <br />mining land use is pastureland. <br />The permit sign was posted at the entrance to the site and the boundary of the affected land was clearly <br />delineated per lkule 3.1.12. According to the Operator, mining operations have been complete for over five <br />years. Rule 3.13 states that all reclamation shall be carried to completion by the Operator within five years from <br />the date the Operator informs the Division that mining has ceased. Since mining at the site has been complete <br />for five years, the site should be fully reclaimed at this point. However, the Division is willing to grant the <br />Operator an addition 365 days from the date of the inspection to complete reclamation at the site, please see <br />Page 4 of this report for the required corrective action. The following reclamation must be completed prior to <br />final release: <br />1. Grade flit walls to 4H: IV. The current grade of the pit walls ranges between 2H:1V and 3H: IV. The top <br />of the north pit wall is within several feet of the northern permit boundary. In order to achieve 4H:1 V <br />slopes, the pit floor will need to be pushed up from the bottom of the slope. Any attempt to grade the <br />slope from the top will cause disturbance outside of the permit boundary, which would result in a <br />possible violation for mining outside of the permit boundary. <br />2. Several existing stockpiles will need to be removed from the site or graded into the pit floor or slopes. <br />3. Replace topsoil. <br />4. Seed the disturbed areas. <br />Upon completion of the above reclamation, the Operator may file a written notice of completion of reclamation <br />and request for release of reclamation responsibility. The Operator indicated that topsoil may be imported to aid <br />in the success of vegetation establishment. If topsoil is imported, the Operator will need to provide the Division <br />with notice of any proposed backfill activity not identified in the approved reclamation plan. The Notice to the <br />Division shall include the following: <br />1. A narrative that describes the approximate location of the proposed activity <br />2. The approximate volume of inert material to be backfilled <br />3. A signed affidavit certifying the material is inert, as defined in Rule 1.1(20) <br />4. The approximate dates the proposed activity will commence and end <br />In addition, the Operator indicated the seed mix may be revised prior to final seeding. If the seed mix is altered <br />from the approved seed mix, then the Operator shall submit a Technical Revision to the Division requesting a <br />change in the seed mix. <br />This concluded the inspection.
