2.03.6 Right of Entry and Operation Information (1) Bowie Resources, LLC, purchased the assets of Bowie Resources Limited effective December 31, 2003. Thus, the right of entries described below for Bowie Resources Limited were transferred to Bowie Resources, LLC. Bowie Resources Limited transferred to Bowie Resources, LLC all of its right title and interest to all of the real property it owned in Delta County. This transfer was in the form of a Special Warranty Deed dated December 31, 2003 and recorded at reception number R575229 in the Delta County Records. Private leases, rights of way and other private agreements are transferred through successor in interest clauses. Bowie Resources Limited assigned all of its Federal Coal Leases and Federal Rights of Way to Bowie Resources, LLC. The Federal Coal Leases and Federal rights -of -way require approval from the Bureau of Land Management. The BLM approved assignment of the Federal rights -of -way through its decision dated March 5, 2004. The BLM approved assignment of the Federal Coal Leases through its decision dated February 4, 2005. Land use permits and highway access permits go with the land so no transfer is required. The deeds, leases, easements and rights -of -way listed and described below • granted Bowie Resources, LLC the legal right to enter and begin surface coal mining operations in the permit area for the proposed Bowie No. 2 Mine. None of the legal interests involved are presently the subject of litigation and none of the easements or leases are temporary. A certain Special Warranty Deed, Assignment and Bill of Sale with Reserved Royalty recorded in Delta County, CO in book 0735 at page 437 granted Bowie Resources Limited the right to enter the property and mine coal. The right is not the subject of pending litigation. The applicant owns the surface and the coal on the property. The Special Warranty Deed is presented in Volume III, Exhibit 1. Following are a list of Deeds that document the Operator has purchased certain parcels located south of old State Highway 133. The Deeds are presented in Volume III, Exhibit 1.
