INTRODUCTION <br />Purpose of this Document <br />This document presents the findings of compliance and the proposed decision of the <br />Colorado Division of Reclamation, Mining, and Safety (Division) for Termination of <br />Jurisdiction (TOJ) at the Trinidad Basin Mine, permit # C-81-048. The Trinidad <br />Basin Mine is a permit revocation/bond-forfeiture site. The permit area under <br />consideration for termination of jurisdiction and final liability release is 1167 acres of <br />which 254 acres was disturbed and subsequently reclaimed at the mine site. A coal <br />loadout adjacent to the railroad track along Linden Avenue in Trinidad was <br />previously disturbed and reclaimed for industrial purposes during final reclamation. <br />This termination of jurisdiction process was initiated by the Division following <br />completion of the required minimum ten-year liability period for reclamation and <br />revegetation of the disturbed area, approximately 74 periodic field inspections, and <br />two years of vegetation sampling and analysis conducted at the site in 2007 and 2008. <br />Background Information Sources <br />The Division will follow the requirements for review, public notice, and public <br />participation as required for a bond release application in accordance with Rule <br />3.03. Detailed information about the bond release review process can be found in <br />the Colorado Surface Coal Mining Reclamation Act, the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining, and in the Guideline <br />Regarding Selected Coal Mine Bond Release Issues, dated April 18, 1995. <br />Detailed information about mining and reclamation operations at the Trinidad <br />Basin Mine can be found in mining and reclamation permit application (# C-81- <br />048) and associated records on file at the Division offices, located at 1313 <br />Sherman Street, Room 215, in Denver, Colorado.
