V. SUMMARY <br />The Trinidad Basin Mine is a permit revocation/bond-forfeiture site. No public <br />comments were received concerning the TOJ process from the public or from the <br />landowners within the permit area. The landowners or their representatives did not <br />attend the final inspection and have voiced no objections during the revegetation <br />liability period. Periodic Division field inspection has identified no significant on- <br />the-ground issues and final inspection indicated the site is in good to excellent <br />condition. Pollution of surface and/or ground water as a result of mining is not <br />occurring and the likelihood of future occurrence is negligible. The post-mining land <br />use of rangeland has been achieved for the eastern %2 of the permit area, with a self- <br />sustaining mix of grasses and forbs well established as demonstrated by results of <br />two years of vegetation sampling. Actual use of the reclaimed area for cattle grazing <br />has been demonstrated and observed during the later years of the revegetation period. <br />A residential use has been achieved for the western %2 of the permit area. The <br />reclaimed site presents no hazards to public health and safety. <br />VI. PROPOSED DECISION <br />The Division finds that all surface coal mining reclamation operations have been <br />completed in accordance with the approved reclamation plan and that the Trinidad <br />Basin Mine meets all reclamation requirements of the Rules and the Act, to the extent <br />possible considering the revoked status of the permit. The site appears to have <br />successfully achieved the post mining land uses. Based on the findings set forth <br />above, the Division proposes to terminate jurisdiction at the Trinidad Basin Mine. <br />This proposed decision terminates all Division of Reclamation, Mining, and Safety <br />involvement for the permit area of the Trinidad Basin Mine. <br />Any person with a valid legal interest, which might be adversely affected by this <br />proposed decision, may request a formal public hearing before the Mined Land <br />Reclamation Board in accordance with Section 3.03.2(6). Public notice of this <br />proposed decision will be published once each week for two consecutive weeks in <br />The Chronicle-News as soon as possible. Requests for public hearing must be <br />submitted to the Division in writing within thirty days of the first publication in the <br />The Chronicle-News. If no hearing is requested within thirty days, the Division's <br />decision will become final. <br />VII.
