The Division has completed its review of the above referenced report received on 16 Feb 2010. The
Division finds the 2009 Annual Reclamation Report in compliance of the following Rules:
Rule 2.04.13(1) - Received 16 Feb 2010. Please see comments below.
Rule 2.04.13(1)(a) - The cover of the ARR includes the name of the permittee, the address, and the
permit number.
Rule 2.04.13(1)(b) - The ARR identifies 4.99 new disturbed acres during calendar year 2009. It is
noted that these acres reflect LWB 11 holes, nitrogen injection holes, return shaft 5 and associated
roads. This disturbance was approved through MR-140, MR-142, and TR-67.
Rule 2.04.13(1)(c) - The ARR identifies 7.17 new backfilled and graded acres during calendar year
2009. It is noted that these acres reflect SC-HG11, SC-HG20, SC-HG33, SC-HG44, SC-HG54, SC-
HG56, SC-HG59, SC-SL1, SC-TG29, SC-TG33, SC-TG53, SC-TG56, LWBIO-2, LWB9-2, and RS-3.
Rule 2.04.13(1)(d) - The ARR identifies 7.17 new topsoiled acres during calendar year 2009. It is
noted that these acres reflect SC-HGI 1, SC-HG20, SC-HG33, SC-HG44, SC-HG54, SC-HG56, SC-
HG59, SC-SL1, SC-TG29, SC-TG33, SC-TG53, SC-TG56, LWB10-2, LWB9-2, and RS-3.
Rule 2.04.13(1)(e) - The ARR identifies 7.17 acres which were permanently revegetated during
calendar year 2009.
Rule 2.04.13(1)(f) - The location and dates of planting for all previously revegetated areas is listed on
page 2 of the ARR.
