Martin <br />Executive Director <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, <br />Section 118, Paragraph 3, of the Colorado Revised Statutes, that on March 1, 2010, an application to revise coal <br />mining operations at the Bowie No. 2 Mine was considered complete for the purposes of filing. All review and <br />comment periods as provided in the Act and the Regulations initiate from this date of filing. <br />Due to difficult mining conditions in the northern part of the Bowie No. 2 Mine permit area, Bowie Resources <br />LLC (BRL) is proposing in Permit Revision No. 12 (PR-12) to curtail mining to the north and expand mining to <br />the west of their current permit area. BRL intends to transfer about 2,379 acres of their Bowie No. 1 Mine permit <br />area and add about 57 acres of new area on the west side of Terror Creek in Sections 8 and 17 of T 13S, R 91W <br />into their Bowie No. 2 Mine permit area. Under a separate permit revision, the Bowie No. 1 Mine permit area <br />will be correspondingly reduced in size by about 2379 acres. All Bowie No. 1 Mine baseline information, <br />hydrology and subsidence monitoring and liability in the transferred permit area will remain the responsibility of <br />BRL but through the Bowie No. 2 Mine permit. <br />Portions of federal coal leases C-37210, C-27442 and D-036955, originally assigned to the Bowie No. 1 Mine, will <br />be accessed underground from the Bowie No. 2 Mine to the east. In addition, BRL has applied for a lease <br />modification to lease D-036955. Five east-west trending longwall panels in the upper B coal seam are planned for <br />mining west of Terror Creek. The longwall reining will result in subsidence. Portions of Steven's Gulch Road and <br />the Pitkin Mesa Pipeline are projected to be impacted to a negligible to slight degree by subsidence. Mining is <br />proposed under federal and private lands. <br />The coal to be mined and the federal land to be mined under are managed by the Bureau of Land Management. <br />Other than the effects from mining-induced subsidence, there is no new surface disturbance proposed in PR-12. In <br />PR-12 there is no proposed increase in the rate of coal production and no proposed increase in water usage at the <br />mine. <br />The Division requests written verification regarding Federal mining leases and/or federal surface access approval. <br />Bowie Resources LLC has referenced the Federal mining lease(s) and/or Federal Surface access agreements C- <br />37210, C-27442 and D-036955 in this application as a document upon which they base their legal right to enter. <br />Please verify that the leases and agreements have been issued and that final BLM/federal agency lease/agreement <br />approval has been granted. If the lease/agreement application is pending, please notify DMG as to the status of the <br />lease/agreement review and when a decision is anticipated.
