Cattany <br />© Division Director <br />\ Natural Resource Trustee <br />New Horizon Mine - Permit No. C-1981-OQ8`__ <br />Permit Revision No. 6 (PR-06) <br />Post-Mlning.Land Use, Sediment Control Final Contours, and Prime Farmland <br />Preliminary Adequacy Review <br />Dear Mr. Gubka: ` <br />.• <br />The New Horizon Mine permit was recently renewed with the issuance of RN-05 on the 3rd of <br />October 2009. By Stipulation No. 16, attached to the renewal, the Division of Reclamation,. <br />Mining and Safety (the Division) required Western Fuels - Colorado (WFC) to submit a permit <br />revision application within 30 days. The permit revision application was to include <br />comprehensive amendments to the site description and land use, vegetation information, prime <br />farmland investigation, revegetation, postmining land uses, and prime farmlands sections of the <br />permit. <br />- r <br />In response to Stipulation No 16, WFC submitted the PR-06 application on the 12tr of November ' <br />2009. The Division determined the application to be complete for purposes of filing on the 23rd <br />of November. The Public Notice appeared in the San Miguel Basin Forum. on the 3rd, 1.0`h, 17' <br />and 24th of December.2009. <br />e <br />Written comments regarding the PR-06 application have been received from Jim Boyd, of the <br />NRCS; from landowners; and from numerous citizens. The public comment period,extends;30 <br />days from the fourth publication of the notice, and will close on Saturday, the 23rd of January <br />2010. The Division has. transmitted copies of the comments received to WFC at regular intervals <br />throughout the public comment period. A list of the letters the Division received and has, <br />transmitted is attached. Due to the level of public interest generated by PR-06, the Division will <br />be hostigg,.an: informal-- conference in Nucla on the 18th of February 2010. <br />`•
