• fine, imprisonment, or both.
This entire revision is lies. Facts: Ross there is No such thing as corrugated irrigation pipe and
nor have we ever used this. For your future information, corrugates and furrows are the same
thing. Next lie, we have not flood irrigated the Morgan property for 39 years, but this was not
nor has ever been Wild Flood irrigated, nor has Bensons, Lloyds, Or Johnsons. Next 70 shares
did 22 acres. How stupid can you be? If we used 70 shares for 22 acres, we would have a large
lake and all of us could go fishing. The Morgan Property was owned by Frank Morgan since
1959 and has been historically irrigated and cropped for that length of time. We use gated pipe
big guns, side rolls and a center pivot to irrigate with and have since the mine signed the lease in
1998 with Frank Morgan and since the beginning of WFC. Ross Gubka states that it took us 10
days or longer to get across the SUNSHINE PLACE which again is all lies. We had gated pipe
across the top and furrowed and gated pipe across the middle and a traveling big gun in the
triangle. Usually it took 3 to 4 days to irrigated the entire field. Also, when Mr. Morgan was
asked how many shares we used, he truthfully answered 50 which from 1996 to the time of
mining , we had 45, you can check the records and prior to that we had 60, but that included also
our corn field which by the way, got approximately 700 ton of corn off this year, so when he left
the 50 shares with the place, that was MORE than what we had been using and seemed a fair
amount, but they could have more if they needed and we have offered another 12 shares and they
have refused. The water is in a large pipe and to allow them more water is just the turn of a
valve. The DRMS rules and laws state that prime farmland is considered prime if it has been
historically irrigated. This has been documented by NRCS as well as ourselves and is a proven
• fact. The law does not state that because WFC is using another type of irrigation, that we have to
be able to prove each and every share with all of Ross's cuts and lies, it says historically irrigated
and has a dependable water SUPPLY. I have all of DRMS laws and according to the LAW, and
their rules and regulations, The Morgan properly is prime soil as well as prime farmland and
according to DRMS laws it must be put back in as good as or better condition and in CROPS and
in a timely manner in full production to producing as much or more than it already was.
For everyones information, WFC as well as DRMS is trying to put this prime farmland into
DRYLAND with the primary shrub to be sagebrush and will not be irrigated and must resemble
the reference area at the airport. DRMS is trying to say the Morgans do not have enough water
because of all the false information that Ross Gubka has provided and continues to provide, He
takes cuts such as a 12% loss in the line, which for the 30 years Frank Morgan was on the Board
and at the meetings, it was always 10%, but that was completely to the end of the park, not to us.
WFC has used lies such as they cannot find an irrigator that would change siderolls twice a day.
This is a flat out lie since we are the irrigators and farmers and have a contract stating such and
for the 13 years that we worked for WFC, we were on 24 hour a day call, 7 days a week, and
changed side rolls twice a day and everyone in this room can stand behind that. We never and I
say again NEVER took a day off and during farming season, you can ask any farmer in here if
they get to take a vacation or go fishing or stop farming during farming season and you will be
told NO we do not get days off. It is a 7 day a week committment. So, don't figure all of these
days and vacations when you are figuring how many shares can do what when your facts are
• based on total lies. NRCS provides you with documentation based on the FACTS or information
