Martin <br />Windsor, CO 80550 Executive Director <br />Re: Keenesburg Mine, C1981-028, Partial Phase III Bond Release Application, SL5 Incompleteness <br />Dear Mr. Savage: <br />The Division has received an application for a partial Phase III Bond Release at the Keenesburg Mine. <br />The Division has reviewed the application for completeness in accordance with Rule 3.03.2(1). <br />In order to determine a bond release application complete, a public notice, in accordance with Rule <br />3.03.2(1)(b) needs to run in a newspaper of local circulation to the mine once per week for four <br />consecutive weeks. CEC provided a copy of the public notice that they will run in the Fort Lupton Press. <br />The Fort Lupton Press is an appropriate newspaper that is circulated and distributed to the Keenesburg <br />area. The Division reviewed the proposed public notice and requests the following correction prior to <br />CEC publishing the notice. <br />A. Please add information regarding a request for liability release for topsoil replacement. Although Rule <br />3.03.1(2)(b) does not specifically state topsoil replacement, the Division has long considered topsoil <br />replacement a Phase II bond release item. <br />B. Please include the applicable topsoil replacement documentation for the areas requested for bond <br />release in the SL5 application. <br />Once the topsoil replacement information is incorporated into the proposed public notice, CEC may <br />proceed to publish the notice. <br />Upon receipt of the proof of publication of the public notice, and submittal of topsoil replacement <br />documentation, as required by Rule 3.03.2(1)(d), the Division will be able to determine if the application <br />is complete and schedule a bond release inspection within thirty (30) days of finding the application <br />complete.
