Prime farmland is the Historic Use of cropland(remember that's 5 out of 10 years prior to <br />leasing, not entering your property, but leasing your property,( that has been used as cropland) <br />with the best combination of both physical and chemical characteristics Water still has not <br />entered the picture. So, please don't add your own things to these laws. So, Mr. Morgan has <br />used his land for cropland for 50 years which is the historic use of cropland. <br />The Prime Farmland Criteria then needs to be met. Historic used for cropland. Still this is 5 out <br />of 10 years prior to the mine leasing the property, still no water involved. Mr Morgan has <br />historically used his land since 1959, all that is being mined, as cropland.. <br />Then the slopes must be less than 6%. Morgans property is 1 to 3 % <br />Then It has more than a 90 day growing period, which it does. <br />The soils are not rocky which they are not <br />It has an adequate and dependable water supply. This has been taken totally out of context by all <br />of you. A dependable water supply is the CC Ditch. It is not the individual irrigating to each <br />property. It is the water system than has been designated for the entire area which we are out of <br />the San Miguel River and we are the CC Ditch of which Frank Morgan is the largest <br />Stockholder. The adequate and dependable water supply is one that is GOOD 8 OUT of 10 <br />YEARS. <br />Now the last is it must have Prime Farmland Soils and has been designated as such. We have the <br />Barx -Darvey Soils so this brings in the water in a soil perspective. So, Mr. Morgan has <br />Historically, cropped and irrigated his property since 1959, 50 years, with 50 Shares of water. <br />Still the IRRIGATION SYSTEMS ARE NOT A PART OF THIS DETERMINING THAT IT IS <br />PRIME FARMLAND. <br />Now, The entire acreage of Mr. Morgan is Now Designated as Prime Farmland. <br />Now, this is when the call to NRCS is suppose to take place to determine how much water it <br />takes for the crop that is being grown.. Prime Farmlands has been determined. So, you find out <br />what kind of crop is being grown. In this case, it's alfalfa. DRMS needs to ask NRCS how <br />much water does it take to sustain an alfalfa field in a season. Not using any type of irrigation <br />system, but just how much water does it take to sustain an alfalfa crop. I can tell you right now <br />and I've included the documents to prove this and NRCS will agree, that 50 shares of water can <br />sustain alfalfa in any given season. No systems yet, just amounts of water. <br />Now how are we going to irrigate to provide proof that 50 shares will sufficiently irrigate all of <br />the Morgan property that has been now determined as Prime Farmland. Here is where the <br />irrigation systems come in. Prior to Mining, we had gated pipe, pump, traveling big gun and a <br />sideroll. All of the properties that Western Fuels have reclaimed are very nice looking and do <br />very well under a side roll and Western Fuels have done a good job. BUT all of the properties
